1. Acceptance of These Terms
These Terms of Use govern your access to and use of The Progress Collective platform, websites, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
2. About the Services
The Services provide AI-enabled tools to assist with business process mapping, document generation, workflow analysis, and governance artefacts.
The Services are provided for decision-support purposes only and do not constitute legal, engineering, safety, compliance, financial, or professional advice.
3. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into this agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Acceptable Use
You must use the Services lawfully and in accordance with these Terms and our Acceptable Use Policy. You must not misuse the Services, attempt to interfere with their operation, or use them for harmful or unlawful purposes.
5. Content, Input, and Output
You may provide information, data, or materials to the Services (“Input”) and receive AI-generated responses or artefacts (“Output”). Input and Output together are referred to as “Content”.
You are responsible for ensuring that your Content does not violate any law, contractual obligation, or third-party right.
6. Ownership and Similarity of Output
As between you and The Progress Collective, you retain ownership of your Input. Subject to applicable law, you own the Output generated for you.
Due to the nature of artificial intelligence, Outputs may not be unique, and other users may receive similar or identical Outputs. This does not grant you rights to any other user’s Output.
7. Accuracy and Human Review
AI-generated Outputs may be incomplete, incorrect, or unsuitable for your specific circumstances. You agree that:
- Outputs may not always be accurate
- You must independently review and validate Outputs before use
- Outputs must not be relied upon as a sole source of truth or as a substitute for professional judgement
8. Our Use of Content
We may use Content to provide, maintain, improve, and secure the Services, comply with legal obligations, and enforce our policies. We do not sell your Content.
9. Paid Services
Some Services require payment. Payments are processed through third-party providers. Subscription terms, renewals, and cancellations are governed by the pricing presented at the time of purchase.
10. Service Availability
While we aim to maintain reliable availability of the Services, we do not guarantee that the Services will be uninterrupted, secure, or error-free. Maintenance, updates, or factors outside our control may occasionally impact availability.
11. Suspension and Termination
We may suspend or terminate your access to the Services if you breach these Terms, misuse the platform, or pose a legal or security risk. You may stop using the Services at any time.
12. Disclaimer of Warranties
The Services are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied.
13. Operational Use Disclaimer
The Services may assist in generating operational documentation such as procedures, work instructions, process diagrams, or governance artefacts.
Users remain responsible for verifying that all outputs comply with their organisation’s safety, regulatory, engineering, and operational requirements before implementation.
14. Limitation of Liability
To the maximum extent permitted by law, The Progress Collective will not be liable for indirect, incidental, or consequential losses. Our total liability will not exceed the amount paid by you for the Services in the 12 months preceding the claim.
15. Export Controls
You must comply with all applicable export control and sanctions laws when using the Services. You may not use the Services in jurisdictions where doing so would violate applicable laws or regulations.
16. Governing Law
These Terms are governed by the laws of the State of Queensland, Australia. The courts of Queensland have exclusive jurisdiction to resolve any disputes arising from or relating to these Terms or the Services.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified through the platform or by email where required.
